Legal Authority to Collect Personally Identifiable Information (PII):
Section 1312(e) of the Affordable Care Act (ACA) required the Secretary of the U.S. Department of Health and Human Services to
establish procedures
under which Agents and Brokers are able to enroll persons into a Qualified Health Plan (QHP) that may be offered on the Federally Facilitated Marketplace (Exchange). This allows Agents and Brokers to collect PII and assist
persons in applying for enrollment, Advance Premium Tax Credits and Cost-Sharing Reductions as allowed to do so under state laws and regulations. (45 CFR 155.220)
Purpose of the Information Collected:
Personally Identifiable Information (PII) is information which can be used to distinguish or trace an individual's identity, such as your name, social security
number, biometric
records, etc. alone, or when combined with other personal or identifying information which is linked or linkable to a specific individual, such as date and place of birth, mother’s maiden name, etc. Middaugh Insurance.
Agent or
Brokers must collect certain Personally Identifiable Information about you in order to help you complete your application for health insurance on the Federally Facilitated Marketplace (FFM or Exchange).
Information That We May Disclose and the Purpose:
We are required to assure that your information is safe. We may need to disclose PII only as permitted or required by law and permitted by you. The
information may be
disclosed to other individuals or entities that will help facilitate legal, enrollment and/or service functions. The following are examples of entities/activities that may be taken on your behalf:

Middaugh Insurance will only use information that you provide us in accordance with applicable law. The purpose of the collection of any Protected Health Information is to facilitate your lawful application for obtaining health insurance through the FFM and any other services as permitted by law.

Is Collection of PII Mandatory or Voluntary?
Collection of your PII is permitted only for purposes of assisting you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in QHPs through the Marketplace, and/or applying for federal subsidies, is voluntary and not mandatory under applicable laws.
The Effects of Non- Disclosure:
If you choose not to provide the requested PII to us, then we may be unable to assist you in comparing health insurance plans, obtaining determinations of eligibility for coverage, enrolling in QHPs through the Marketplace, and/or applying for federal subsidies.
Computer Tracking and Cookies
Our sites are set up to track, collect or distribute personal information entered by visitors. Our site logs generate certain kinds of non-identifying site usage data, such as the number of hits and visits. This information is used for internal purposes by technical support staff to provide better services to the public and may also be provided to others, but again, the statistics contain no personal information and cannot be used to gather such information.
